General conditions and acceptance of terms
Welcome to Crowns & Curls. We are an online hair boutique based in Montreal, Quebec, Canada, selling wigs, weave, hair accessories, and related products through this store, which is hosted on Shopify.
By visiting this store, browsing our products, or placing an order, you agree to these Terms of Service (the "Terms"), our Shipping Policy, our Refund Policy, and our Privacy Policy. If you do not agree with any part of these Terms, please do not use the store or place an order.
You must be of legal age in your province, state, or country of residence to make a purchase, or make purchases only with the involvement and consent of a parent or legal guardian. We may refuse an order or limit service where the law allows us to do so.
Nothing in these Terms limits any right or recourse you have under consumer-protection legislation that cannot legally be waived, including Quebec's Consumer Protection Act.
Our products, descriptions, and accuracy
We sell wigs, ponytails, weave and bundles, extensions (including clip-ins), braiding and crochet hair, accessories, children's items, cosmetics, and salon tools and products.
Product descriptions, specifications, and images are provided to us by our suppliers. We work to present them accurately, but we do not guarantee that every description or image is complete, current, or free of errors. Colours and textures can appear differently depending on your screen, its settings, and lighting; a slight variation between the image and the item you receive is normal and is not, by itself, a defect. Your options if an item arrives damaged, defective, incorrect, or materially not as described are set out in our Refund Policy.
Product availability can change without notice. We may limit the quantity of any product, and we may modify or discontinue a product at any time. A product appearing in the store is an invitation to place an order, not a guarantee that it is in stock.
Prices and currency
All prices are shown in Canadian dollars (CAD) unless clearly stated otherwise at checkout. Standard shipping is included in our product prices; the optional express upgrade is charged at the rate shown at checkout for your country.
Sales taxes are calculated and shown at checkout based on your delivery address. Import duties, import taxes, and carrier handling fees are separate from the prices and sales taxes shown at checkout and are addressed in our Shipping Policy.
We may change prices at any time without notice. The price that applies to your order is the price shown at checkout when you place the order. If a price or other product information contains an obvious error, we may correct it; if the error affects an order you have placed, we will contact you, and you may choose to proceed at the corrected price or cancel that order for a full refund before it ships.
Any discount code or promotion is subject to the conditions stated when it is offered.
Orders, acceptance, and cancellation
When you place an order, you offer to buy the products in it under these Terms. The confirmation email you receive acknowledges that we received your order; it is not our acceptance of it. Our acceptance — and the contract between you and Crowns & Curls — takes effect when we process your payment and begin processing your order, or when your order ships, whichever happens first.
You agree to provide current, complete, and accurate information for your order, including your delivery address and contact details, and to update it if it changes before dispatch. We are not responsible for problems caused by inaccurate information (see "Address accuracy" in our Shipping Policy).
We may decline or cancel an order where permitted by law — for example, if an item becomes unavailable, if order information contains an error, or if we reasonably suspect fraud or misuse. If we cancel an order you have paid for, we will refund the full amount paid to your original payment method.
Your cancellation rights follow our Refund Policy: you may request a cancellation or address change only before your order has been processed or shipped. Contact us immediately at crownsncurls.store@gmail.com. Once an order has been processed or shipped, it cannot be cancelled or redirected.
Payment
Payments are processed securely through Shopify Payments and the other payment methods shown at checkout. We do not receive or store your full card details; they are handled by the payment processor.
By submitting a payment, you confirm that you are authorized to use the payment method provided. Your order total is charged in Canadian dollars. If a payment cannot be verified or completed, we may hold or cancel the related order and contact you.
Approved refunds are issued to the original payment method, as described in our Refund Policy.
Shipping, delivery, and import charges
Orders are prepared by our fulfilment partner and shipped from outside your country of delivery. Processing times, delivery estimates for each country we serve, express options, address accuracy, delays, and lost orders are all covered in our Shipping Policy, which forms part of these Terms. Where these Terms and the Shipping Policy differ on a shipping matter, the Shipping Policy applies.
Delivery times are estimates only and are not guaranteed dates. An order is treated as delivered when the carrier records it as delivered to the address you provided, subject to the delivered-but-not-received process described in the Shipping Policy.
Orders shipped internationally may be assessed import duties, import taxes, and/or carrier handling fees by customs authorities or the carrier. Unless a product page or checkout expressly states that import charges are included for the shipping method you chose, those charges are your responsibility and may be payable before or on delivery, as explained in our Shipping Policy.
Returns, exchanges, and refunds
Returns, exchanges, store credit, and refunds are governed by our Refund Policy, which forms part of these Terms. Please read it before ordering: in particular, hair products are final sale for change of mind, and no return is accepted without our prior written approval. Where these Terms and the Refund Policy differ on a returns matter, the Refund Policy applies.
Where the Refund Policy provides store credit as a remedy, the credit may be applied to a future purchase at Crowns & Curls and has no cash value.
Intellectual property
The Crowns & Curls name and wordmark, and this store's text, layout, and design, belong to Crowns & Curls or its licensors and are protected by applicable intellectual-property laws. You may browse the store and use its content for your personal, non-commercial use only. You may not copy, reproduce, republish, or use our name, wordmark, or content for commercial purposes without our prior written permission. Product images and descriptions are provided by our suppliers and are used with their permission; the same no-commercial-use rule applies to them.
If you send us a review, comment, photo, or other content, you keep ownership of it, but you give Crowns & Curls a non-exclusive, royalty-free licence to use, reproduce, and display it in connection with operating and promoting the store. You confirm that content you submit is yours to share and does not infringe anyone else's rights. Prohibited uses
You agree not to use this store, its products, or its content:
- for any unlawful purpose, or in a way that violates any law or regulation;
- to place an order with false, incomplete, or misleading information, or with a payment method you are not authorized to use;
- to infringe our intellectual-property rights or those of our suppliers or any third party;
- to harass, abuse, defame, or discriminate against any person;
- to upload or transmit viruses, malware, or any code intended to harm the store or its users or to interfere with its operation;
- to scrape, data-mine, or systematically extract content from the store without our written permission;
- to interfere with the store's security features or attempt to gain unauthorized access to our systems or those of Shopify or our payment processors;
- to send spam or unsolicited advertising through or about the store.
We may suspend or end your access to the store if you breach these Terms or use the store in a prohibited way, and we may cancel orders connected with that use.
Disclaimer and limitation of liability
This store and our products are provided "as is" and "as available" to the fullest extent permitted by law. We do not promise that the store will always be available, uninterrupted, or error-free, and we are not responsible for delays or failures caused by events outside our reasonable control, including carrier disruptions, customs processing, weather, and labour disruptions.
To the maximum extent permitted by law, our total liability arising out of or relating to an order is limited to the amount you paid for the item or order concerned, and we are not liable for indirect, incidental, or consequential losses (such as loss of profits or loss of an opportunity).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Nothing in these Terms limits, waives, or replaces any right, warranty, or recourse you have under consumer-protection legislation, including Quebec's Consumer Protection Act and, where they apply, the mandatory consumer laws of your province, state, or country of residence.
Privacy
Your personal information is collected, used, and disclosed as described in our Privacy Policy, which forms part of these Terms. To operate the store and fulfil your order, we share the information needed for each step — such as your name, delivery address, contact details, and order details — with Shopify (our store platform), our payment processors, and our fulfilment supplier and the carriers that deliver your order, including parties located in China. Please read the Privacy Policy for details, including your rights and choices.
Changes to these Terms
We may update these Terms from time to time by posting the revised version on this page. The version posted when you place an order governs that order. Changes apply to visits and orders made after the revised Terms are posted. We encourage you to review this page periodically. These Terms are available in English and French.
Governing law and disputes
These Terms, and every purchase from this store, are governed by the laws of the Province of Quebec and the laws of Canada applicable in Quebec. If a dispute arises, please contact us first at crownsncurls.store@gmail.com so we can try to resolve it with you.
If you are a consumer, this section does not deprive you of the protection of the mandatory consumer-protection laws of your province, state, or country of residence, and does not limit any recourse those laws give you.
General provisions
If any part of these Terms is found unenforceable, that part will be limited to the minimum extent necessary, and the rest of the Terms will remain in full effect. Our failure to enforce any part of these Terms is not a waiver of it. These Terms, together with the Shipping Policy, the Refund Policy, and the Privacy Policy, are the entire agreement between you and Crowns & Curls about your use of the store and your purchases, and they replace any earlier understandings about those subjects.
